The Environmental Cleaning Tax (ÇTV), which closely concerns property owners and users, is a legal obligation for the continuity of municipal services. To maintain the cost balance in property management, it is important to understand the scope of this tax and the payment obligations correctly.

What is the Environmental Cleaning Tax (ÇTV)?

The Environmental Cleaning Tax is a service fee collected in return for garbage collection, sewage, and environmental arrangement services provided by municipalities, as per Law No. 2464 on Municipal Revenues. Residential, commercial, and all other buildings are subject to this tax.

Basic Features of ÇTV

  • Service Oriented: It is collected as a counterpart for the cleaning service provided rather than based on the value of the property.

  • Liability is Based on Usage: The actual liable party for the tax is not the property owner, but the person who is actually using the property.

  • Continuous: It is accrued annually as long as the property is used.

How is the Environmental Cleaning Tax Calculated and Paid?

Do Tenants Pay the Environmental Cleaning Tax?

Yes, according to Law No. 2464 on Municipal Revenues, the Environment Cleaning Tax (ÇTV) is paid by the person who actually uses the building. If a tenant resides in the property, since the tenant benefits from the cleaning service provided by the municipality, they are also responsible for the tax.

  • Situation in Residential Properties: Once the tenant takes over the water subscription, the ÇTV amount is automatically reflected in the water bill and paid by the tenant along with the water fee.

  • Situation in Commercial Properties: The tenant using the commercial property is obliged to directly pay the tax in two installments annually by submitting a declaration to the municipality.

  • If the Property is Vacant: If there is no tenant in the property and it is empty, the payment responsibility passes to the property owner.

Individuals and Institutions Exempt from the Environmental Cleaning Tax:

  • Owners of Vacant and Unused Buildings: Buildings that are empty, uninhabited, and have no water/electricity consumption are exempt from tax. (This circumstance must be reported to the municipality with a petition).

  • General and Special Budget Administration: State offices, municipalities, provincial special administrations, and service buildings belonging to these institutions.

  • Places of Worship: Mosques, churches, synagogues, and other places of worship.

  • Educational and Health Institutions: State-owned schools, universities, hospitals, and health centers.

  • Diplomatic Missions: The embassy and consulate buildings of foreign states, provided they are reciprocal.

  • Public Benefit Associations Such as the Red Crescent: Buildings of non-profit institutions that have been granted exemption by law.

  • Poor and Disabled Individuals: In some local government practices, exemptions or discounts may apply for individuals with disabilities, veterans, and relatives of martyrs, who have single residences not exceeding a gross area of 200 $m^2$, similar to property tax exemptions in ÇTV.

Who Pays the Environmental Cleaning Tax?

The person actually using the building is responsible for the tax. If there is a tenant (or a short-term guest, not a contractual tenant) in the property, the tenant pays the tax. However, if the property is vacant, the responsibility entirely belongs to the property owner.

Is the Environmental Cleaning Tax Paid for a Vacant Apartment?

If your property is empty and not in use, you have the right to a tax exemption. To claim this, you must submit a written request to the municipality, along with documents proving that the property is empty and that there is no electricity or water consumption. The tax will continue to accrue unless a notification is made.

How Should CTV Management Be in Airbnb and Short-Term Rentals?

Although the property is used like a "commercial enterprise" in the Airbnb model, if it is designated as residential in the title deed, the property tax is generally collected through the water bill. However, depending on the status of your property or the practices of the municipality you are connected to (especially after obtaining a tourism certificate), it may be necessary to switch to a declaration method.

What Happens If the TV Tax Is Not Paid?

Delays in the payment of tax debts will incur a late fee under Law No. 6183. Additionally, during the sale or transfer of the property, the "No Debt" document to be obtained from the municipality may be denied due to unpaid environmental tax debts.
